These Terms of Service govern your use of imadefire.com and the services provided by MadeFire LLC. By using the site or engaging us for work, you agree to these Terms.

Agreement to terms

By accessing the site, creating an account, or engaging us, you confirm that you can form a binding contract and that you agree to these Terms and our Privacy Policy. If you are accepting on behalf of a company, you represent that you have authority to bind that company.

About our services

MadeFire is an AI automation studio. We design and build automations, deploy them, and hand them off to operate inside your business. The specific scope, deliverables, and timelines for any engagement are set out in a separate statement of work or engagement agreement.

Account registration

Some features require an account. You must provide accurate information, keep your credentials secure, and notify us promptly of any unauthorized access. You are responsible for activity under your account.

Engagements and fees

Pricing for our engagements is described on the site (Spark, Forge, Blaze, Hourly, and Discovery). Final fees, payment terms, and scope are set out in your engagement agreement. Unless otherwise stated, fees are payable in U.S. dollars and are non-refundable once work has begun.

Acceptable use

You may not:

  • use our services to violate the law or the rights of others;
  • attempt to disrupt, reverse-engineer, or compromise our systems;
  • submit malicious code or harmful content;
  • scrape the site, harvest data, or train models on our content without our written consent; or
  • misrepresent who you are or who you are authorized to act for.

Intellectual property

Our IP. The site, our written materials, brand, designs, and reusable internal tooling are owned by MadeFire and protected by intellectual property laws.

Your content. You retain ownership of content you provide to us during an engagement (your business data, brand assets, written input).

Deliverables. Ownership of work product produced under an engagement is governed by your engagement agreement. Absent a different written term, custom deliverables produced for you become yours upon full payment, and we retain rights to general know-how, libraries, and reusable components developed during the engagement.

Confidentiality

Each party agrees to keep the other's non-public information confidential and to use it only for the purposes of the engagement. This obligation survives the engagement.

Third-party services

Our automations may rely on third-party services (LLM providers, hosting platforms, communication tools). We do not control those services and are not responsible for their availability, accuracy, or terms. Your use of any third-party service is governed by its own terms.

Disclaimers

The site and our services are provided “as is” and “as available.” Except as expressly set out in an engagement agreement, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. AI-generated outputs may be inaccurate; you are responsible for reviewing outputs before relying on them.

Limitation of liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data. Our aggregate liability for claims arising out of or relating to the site or any engagement will not exceed the amount you have paid us in the twelve months preceding the claim, or one hundred U.S. dollars (USD 100), whichever is greater.

Indemnification

You agree to indemnify and hold MadeFire harmless from claims arising out of (a) your breach of these Terms, (b) your misuse of the site or our services, or (c) content you submit to us that infringes the rights of a third party.

Termination

We may suspend or terminate your access to the site at any time if you violate these Terms or use the site in a way that risks harm to us or others. You may stop using the site at any time. Sections that by their nature should survive (e.g., intellectual property, confidentiality, disclaimers, limitation of liability, and governing law) will survive termination.

Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the site will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.

Changes to these terms

We may update these Terms from time to time. Material changes will be reflected by the “last updated” date above. Continued use of the site after changes take effect constitutes acceptance.
